Prattville – Councilman Mike Renegar will introduce a resolution during the next Council meeting to authorize the City attorney to file suit against Lexon Insurance Company for the completion of Eastwood Subdivision.
Eastwood is located directly behind the Prattville Town Center and runs along the perimeter of the Robert Trent Jones golf course.
The councilman stated several reasons for the City’s possible legal action.
“According to Joel Duke, City Planner, we have exhausted all means to get the developer, contractor, and bonding company to finish the residential development, to include curbs, guttering, and putting the streets in proper shape so the City can accept it,” he said. “This is our last recourse to get them to do what they should have done long ago.”
Duke further explained that the City accepts a bond on every subdivision that’s platted.
“A guarantee is given to the City so that if the developer fails to maintain the subdivision during a two-year period or if they fail to put down the final asphalt wearing surface, then we have some recourse to get that done,” said Duke. “In the case of Eastwood Subdivision we have made a claim against Lexon Insurance Company who provided the bonds for the developer (Eastwood Developers LLC) and they are simply dragging their feet … so this is just authorizing the City attorney to take action to get them to deal with their obligations.”
